Q. What exactly does “redaction” involve?

Under the Data Protection Acts, there are a few exemptions which entitle the data controller to withhold certain data from the data subject who makes the access request.

Redacting is the blacking out or removal of parts of the data that the data subject is not entitled to receive. Individual words, sentences or whole paragraphs can be blocked out if appropriate. If necessary, sections of a document or whole pages can be removed prior to the release of the document.

If, for example, data relates to an individual other than the data requestor, that data should not be disclosed. Any details that identify the third party should be redacted (unless consent from the third party has been given).

The data subject can appeal the redactions made. If required, Adjuro will furnish a report explaining the decisions taken by it with regard to the redactions made.

Q. What does a data controller need to do to prepare for the redaction of documents by Adjuro?

A request for personal information only applies to information falling within the definition of “personal data” under the Data Protection Acts. Having satisfied itself that it has properly searched all records and retrieved all relevant “data” as defined in the Acts, the data controller should provide Adjuro with 2 copies of all relevant material. All documents should be single sided with no paper clips/staples.

A copy of the redacted data should be made and retained by the data controller.

Q. Where does the redaction take place?

We will attend your premises and review and redact the documents on site. Should it be more convenient for you, copied documents can be taken off site by Adjuro and redacted and returned when complete. Adjuro will NOT remove original documents from the data controller’s premises.

Q. What is the role of Adjuro in the redaction process?

The data controller is responsible for their data redaction. Adjuro offers data controllers expert assistance in the redaction process.

Q. How much time will the redaction take?

Once a valid request has been received, a data controller is obliged to furnish all relevant data to the subject within 40 calendar days (currently). The amount of time it will take to redact will depend largely on the volume of data to be reviewed and redacted. It is highly advisable therefore to retrieve and prepare all documents as soon as possible after a valid request has been received. Adjuro should be contacted by the data controller at the earliest opportunity.

Q. How much does Adjuro charge for its redaction services?

Adjuro offers a commercially competitive hourly rate and a daily rate up to and including three days. Should the access request exceed three days, we offer a reduced rate.
